OPINION | The denial of a right to Judge Ivo Rosa

The rule of law is weakened when one of its representatives, such as the Public Prosecutor's Office, denies citizens the right to question the terms under which an investigation was conducted against them.

Opinion article by Carlos Melo Alves in the Expresso newspaper, reflecting on how the rule of law is called into question when the Public Prosecutor's Office prevents a citizen from knowing the terms under which they were investigated. It refers specifically to the case of Judge Ivo Rosa, who has been the subject of several criminal investigations without ever having been charged.

This raises the question of whether the person concerned has the right to access the case file and to scrutinise the authorities' access to their communication data. The Portuguese Constitution imposes on the State the duty to guarantee the right of access to justice, so that whenever an investigation is conducted in secret, there must be a mechanism in place to allow the person concerned to subsequently ascertain the circumstances and grounds for the measures that affected their privacy, without compromising the outcome of the investigations.
